Refund Policy
Effective date: [Launch date] Last updated: [Launch date]
1. About this policy
This Refund Policy applies to purchases of Cinax Pro licences (“Licences”) from Gambit Digital Solutions Limited (“Gambit”, “we”, “our”, “us”). It should be read together with our Terms of Use and Privacy Policy.
We want you to be confident in your purchase of Cinax Pro. This policy describes the circumstances in which we will provide a refund, and how to request one.
This policy does not affect any statutory rights you may have as a consumer under the Consumer Rights Act 2015 or any other applicable law.
2. Statutory cooling-off period (consumers in the UK and EU)
If you are a consumer resident in the United Kingdom or the European Union, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or the equivalent local legislation implementing the EU Consumer Rights Directive) to cancel your purchase of a Cinax Pro licence within 14 calendar days of the date on which the contract was concluded (typically, the date your Licence Key was delivered), without giving any reason.
2.1 Loss of the right to cancel
The statutory cooling-off period for digital content is lost as soon as the supply of the digital content begins, where you have given express consent to that supply and have acknowledged that you will lose your right to cancel.
When you check out for Cinax Pro and we deliver your Licence Key, we treat this as an express request from you for immediate supply of the digital content. We will ask you to confirm that you wish to receive immediate delivery and that you understand this will end your statutory right to cancel.
If you do not provide that confirmation, you cannot use the Licence Key until the 14-day period has elapsed; if you do provide that confirmation and activate the Licence, you lose your statutory right to cancel.
This restriction applies only to the statutory cooling-off period and does not affect our voluntary refund guarantee described in section 3 below.
2.2 How to exercise your statutory right (where it has not been lost)
To exercise your statutory right to cancel, you must inform us of your decision by an unambiguous statement (for example, an email to [email protected]) before the end of the 14-day period.
You may use the following model cancellation form, but it is not obligatory:
To: Gambit Digital Solutions Limited ([email protected])
I hereby give notice that I cancel my contract for the supply of the following digital service: Cinax Pro licence.
Date of purchase: [DATE]
Order reference (if known): [REFERENCE]
Name: [YOUR NAME] Email address used at checkout: [YOUR EMAIL]
If your statutory right of cancellation has not been lost under section 2.1 and you exercise it within the 14-day period, we will refund the full amount paid (using the same means of payment used for the transaction), without undue delay and in any event within 14 days of being informed of your decision to cancel.
3. Our 30-day satisfaction guarantee
In addition to your statutory rights, we offer a voluntary 30-day satisfaction guarantee on every Cinax Pro purchase.
If, within 30 calendar days of your purchase, you are not satisfied with Cinax Pro for any reason, you may request a refund by emailing us at [email protected]. Please include:
- Your name and the email address used at checkout;
- The approximate date of purchase; and
- A brief reason for the request (we ask this only so we can improve the product — your refund does not depend on the reason being judged acceptable).
We will process eligible refund requests within 14 calendar days of receipt, using the same payment method used for the original transaction. Card refunds may take several additional business days to appear on your statement, depending on your card issuer.
3.1 Requirements
To be eligible for a refund under our 30-day satisfaction guarantee:
- The refund request must be made within 30 calendar days of the date of your purchase;
- The request must be made from, or relate to, the email address used at the time of checkout;
- The refund must be requested via email to [email protected] (chargebacks initiated through your card issuer or bank are not covered by this voluntary policy and may instead be resolved through the chargeback process).
3.2 Refund and licence revocation
When we issue a refund under this section 3 or under section 2:
- Your Licence Key will be deactivated within a reasonable period following the refund. Once deactivated, the Licence Key will no longer unlock Cinax Pro features in the Application.
- You agree to uninstall any active installation of Cinax Pro and not to continue to use Cinax Pro features following deactivation. Cinax Free will continue to be available to you without restriction.
We retain a record of refunded transactions for the purposes of accounting, fraud prevention, and to prevent repeat refund requests for the same purchase.
4. Circumstances in which a refund will not be granted
Subject to your statutory rights (which are not affected by this section), we may refuse a refund request in the following circumstances:
- The request is made more than 30 calendar days after the date of purchase, and your statutory cooling-off period (if any) has expired or been lost under section 2.1.
- You have previously received a refund under this policy for a Cinax Pro purchase, and you are attempting to repurchase and refund again as a pattern.
- We have reasonable evidence that the Licence Key was used in violation of our Terms of Use, including (without limitation) distribution to third parties, attempts to circumvent licence-validation systems, or use in connection with unlawful content.
- The request relates to a chargeback or dispute already initiated through your card issuer, in which case the chargeback process applies in place of this policy.
If we refuse a refund request, we will explain our reasons in our reply.
5. Faulty software or service failure
If you believe that Cinax Pro has a fault that prevents it from working substantially as described on the Website at the time of your purchase, please contact us at [email protected] and describe the issue, including the version of Cinax, your operating system, and steps to reproduce the fault.
We will work with you in good faith to investigate the issue, and where appropriate we will:
- provide an updated version of the Application that resolves the fault;
- provide a workaround; or
- if the fault cannot reasonably be resolved within a reasonable period, offer a refund.
This is in addition to any rights you have as a consumer under the Consumer Rights Act 2015 in respect of digital content that does not conform to the contract (including remedies of repair, replacement, price reduction, and refund).
6. How to request a refund
All refund requests should be sent to [email protected], including:
- The email address used at checkout;
- The approximate date of purchase;
- An indication of the basis for the request (e.g. “30-day satisfaction guarantee”, “statutory cancellation”, “fault”).
We will acknowledge receipt and respond within 5 business days. We will issue any eligible refund within 14 calendar days of confirming eligibility, by the same payment method used at checkout.
7. Updates to this policy
We may update this Refund Policy from time to time. When we make a change, we will update the “Last updated” date at the top of this policy.
Your refund rights are determined by the version of this policy in effect at the time of your purchase, together with any statutory rights applicable to you at the time.
